I just don't understand this. Does Jay not understand that he just made the case for Sotomayer stronger? With Specter (who is not hostile to the Est Cl) now among the Democrats and a 60th vote to avoid a filibuster, complaining she is strong on sep of church and state is playing to her strength. One of the most serious fears for a lot of groups about the post Rehnquist Court has been that the Establishment Clause would disappear.
