Cert granted on Chandler, Judgment Vacated

If the judge in Chandler committed any  errrors,-alleged about the exact
scope of an injunction as it affected conduct on the border between private
and state action-- they pale into insignificance compared to the blatant and
deliberate efforts of the school board--defended by the American Center for
Law and Justice--to ignore any decision which prohibited the public schools
in this Alabama County to function as adjuncts of the prevailing religious
sentiment. It was I concede clever lawyering not to appeal those parts of the
judgment which were incontestable and to have the case look like it was only
about judicial over reaching. That  is simply not Chandler.There iss omething
wrong about protesting the judge's actions in this case as if he were
confronted with a borderline question and used the opportunity to impose a
ban on teligion.This was rather a case of massive resistance which deserved
the most vigorous response.
