In December the Supreme Court of Florida heard argument on whether a claim
against a religious institution based on the negligent hiring of a pastor
may be stated against a church. The basis of the suit was a parionshioner's
claim that, while receiving pastoral counseling, the pastor had a sexual
relationship with the adult parishioner/plaintiff.

After oral argument, the court issued an order which requested briefs
"setting forth legal authorities in support of the same alleged causes of
action in the Second Amended Complaint [breach of fiduciary duty and
intentional infliction of emotional distress] but against defendants who are
not religious entities."

The order may be a bit difficult to follow. If anyone is interested in a
copy of an amicus brief I filed on the issue, let me know by private email.
