Implicit cutbacks on 1st Am protections

I believe Akhil Reed Ahmar has made a suggestion along the line suggested
that the First Amendment must now be interpreted in light of the Fourteenth
heard him suggest as much in a lecture at Harvard. For myself, I would not
hold religious liberty captive to the sorry history of racial discrimination
However, when Doug Laycock and I were lobbying a black democratic Congressman
about what was the first effort to replace RFRA with legislation which I
have  encompassed claims of racial discrimination, the legislator  was
sincerely convinced in ways that I was not that allowing any legitimacy to
claims of racial discrimination would lead to a resurgence in racism. I
remember remarking to Doug that this was a  vivid illustration of the depth
of the gap in racial perceptions in America.I suspect the same is true of
this thread.
