One other thought on the distinction between the church and church social
services. IN Corporation of the Presiding Bishop v. Amos, those challenging
Title VII's blanket exemption of religious institutions from the ban on
religious discrimination suggested that the exemption would be constitutional
as to the church itself, but not social service agencies. The Court rejected
this submoission,largely on the grounds that it posed entanglement problems
of its own.
The California employment discrimination statute has a blanket exemption for
all religious institutions, including (by decision of the California Supreme
Court), hospitals. The exemption applies not only to religious
discrimination, but race(!) and sex as well.
