Christopher Wolfe has made the freedom of contract argument in favor of
covenant marriage laws in an article entitled "The Marriage of Your Choice"
in First Things. A copy of the article is available at the journal's website
<www.firstthings.org>. I use it in my Property I class in our discussion of
marital property law. Student reaction to the proposal is usually quite
diverse and strongly held, although I confess my favorite exchange was
initiated by a male student who, in responding to the argument that such law
would require the couple to consider and discuss their expections prior to
marriage, replied that he was opposed to the proposal because "all" women
would demand the protection of limiting marital termination to cases "for
cause" and he thus would never find a wife. A woman law student responded
that she found it interesting that he believed he could only find a wife by
relying on her ignorance of his true intentions -- a marriage terminable at
will.
