For what it's worth--and it's only the opinion of a long-time, mostly
lurker here--I am sorry that Eugene Volokh has decided to convert the
list to a moderated one.

In my opinion the thing that has made the administration of this list so
impressive in the past has been his gentle and even-handed way of keeping
participants' attention focused to its main purposes. As I understand it,
postings will have to pass by him first, losing a bit of the spontaneity
that we've had, and he will have to read all the postings first, a much
more onerous task, it seems to me, than gently nudging participants back
to the line when he has read them like the rest of us. Has this
"solution" been occasioned by a problem that I, for one, have missed?

Still it is his decision and his task, and I am willing to accede to
it--particularly since I have no other choice if I want to listen to some
of the top thinkers in government and religion comment on the passing
constitutional (and other) scene.
