Because when it comes to official capacity action (or inaction or
dereliction of commonlaw duty to protect as in the case cited), there is no
such thing as a de mimimus injury when it comes to an establishment clause
If this is the totality of the justification, then I certainly appreciate the
candor with which it is offered.
