I really don't think so.  This is the difference between state endorsement
and accommodation of private decisions.  If the state allowed individuals to
take off their birthdays, I don't think we'd necessarily want to say that
Texas was "observing" their birthdays.  This is, obviously, all very picky
argument, but I think that language matters.
