Adultery in the army

I dunno.  Perhaps it is.  But even if it's not, is the military (or is a
civilian legislature) required to criminalize *all* equally havoc-creating
conduct?  If the government criminalizes the possession of marijuana but not
the possession of tobacco, can that be challenged on the ground that tobacco
causes more problems?
