An ordinance that regulates only churches raises obvious questions
under Smith and Lukumi.
One of the great strengths of this list is that it has people from
all sides on these issues. But that means it is not an appropriate forum
for discussing "the plan" for handling anticipated litigation. If there is
a plan for this case, those who know about it should respond to Mary off list.
In general, those of us who talk about pending cases should not
reveal things that would be news to opposing counsel or things covered by
the privilege or the duty of confidentiality. I have been pretty open about
Flores because I think that Marci knows all my arguments by now anyway.
