The standard of care is VERY rarely determined by legal precedent.  The standard of care is determined by what the "average qualified practitioner" does. As such, the standard of care is determined by the profession and not "the law." For an example of the rare case in which the court determined what the standard of care ought to be, see Helling v. Carey, 83 Wash. 2d 514, 519 P.2d 981 (1974).

Muy understanding is that "Standard of Care" is typically determined by legal precedent and commonly lags as much as 10 years behind "state of the art".
