ACA Analogies

Applying Rick's analogies to some of our other commerce clause cases:

Gibbons:

Gibbons wanted to be an international sex slave but Ogden and some NY judges crawled out from under their beds one night and sunk his boat.

Barnwell Bros.

The Barnwells were strutting their stuff up and down the Eastern seaboard when South Carolina told them that they had to lose weight or crawl back under their beds.

Wickard:

Wickard wanted to be a sex slave in the international market but couldn't.  So he thought he would avoid federal regulation by engaging in incest under the bed.

Raich:

Raich wanted to be a sex slave in the international market for her health, but couldn't.  She found that incest was a poor substitute and later crawled under her bed and passed away in great pain.

Printz:

Printz was told that he had to register all the international sex slaves and their pimps, even if he lacked the resources to do so.  There were so many international sex slaves hiding under beds in his small town of Hamilton, Montana, that the registration requirement would have been onerous, so he objected and took his case to the U.S. Supreme Court.

And back to the Affordable Care Act:

DHHS v. Florida:

The entire population of the State of Florida was actually in the international sex slave market.  They hadn't reported for work yet but they were still getting paid.  For some reason they and Rick Duncan were unhappy when the boss showed up and dragged them off to punch in.
