Never mind. I was thinking of City of Boerne v. Flores (1997), in which
Justice Scalia joined all but Part III-A-1 of the majority opinion.

Subject: Scalia & constitutional interpretation
I have what at the moment is only a vague recollection that in one
constitutional case Justice Scalia refused to join a section about
ratification history of some constitutional clause (perhaps in the
Fourteenth Amendment). Can anyone point me to such a decision?
