cyberstalking laws

I may have missed a previous thread on this, but North Carolina has 
criminalized "any electronic communication making a false statement 
concerning death, injury, illness, disfigurement, indecent conduct or 
criminal conduct with the intent to abuse, annoy, threaten, terrify, 
harass, or embarass."   Forty four other states have cyberstalking 
laws.  Currently, two NC students are charged with creating false and 
offensive profiles of Assistant Principals on MySpace.
Is this law not facially overbroad?
