Greetings from Crete.  Two quick comments:  Marty is right that I tend to dwell on Jefferson's comment (and similar statements from Lincoln and other "great" presidents.  Secondly, I'd be a lot happier if the ABA panel were more pluralistic and less so obviously stacked in favor of critics of the Bush Administration.  It is, I think, far easier to deservedly condemn the DOJ memo on NSA surveillance than to generate a full-scale theoretical position that is genuinely compelling across a wide range of issues and contexts.
