It seems entirely possible, if not more than likely, that if Meirs' 
nomination had been brought to the floor Monday morning, Senate 
Minority Leader Harry Reid could have delivered enough votes to 
prevent a filibuster, which conservative Republicans could not have 
joined, and to offset conservative defections on an up-or-down vote. 
A few months ago on this list, the filibuster was condemned as 
anti-majoritarian, and even unconstitutional. It's now revealed that 
advise and consent is not the Senate's constitutional responsibility 
so much as the President's constitutional whim -- prerogative if you 
like -- and that it can be "waived" -- and the will of the majority 
thwarted -- to mollify a handful of conservatives threatening to 
splinter the party. Do the arguments against the filibuster 
countenance or condemn the ability of a handful of Senators rather 
than 40 Senators, using the back door instead of the front door, to 
block an up-or-down vote on a judicial nomination?
