The public works water projects in the 1970s (Locks & Dam 26 on the Mississippi, see Atchison, Topeka, & Santa Fe R. Co. v. Marsh, 655 F.2d 346 (D.C. Cir. 1981), and the Tennessee Tombigbee Waterway, see Louisville and Nashville Railroad Co. v. Alexander, 614 F.2d 474 (5th Cir. 1980), aff'ing Louisville and Nashville Railroad Co. v. Alexander, 501 F. Supp. 242 (E.D. Miss. 1980), were challenged by railroad companies who asserted standing by reason of loss of business to subsidized barge traffic.
