Take a look at Jacobstein and Mersky, The Rejected:  Sketches of the 26 Men
Nominated for the Supreme Court but Not Confirmed by the Senate (1993).  The
book discusses, inter alia,  the failed 1795 nomination of John Rutledge to
be Chief Justice.

        Is there an account of those Supreme Court nominees who failed to
get confirmed? Specifically, during the period between 1789--1803 there was
at least one failed nominee. Is that right? Who was it and what were the
