Some self promotion, but a new state constitutional law publication.
George T. Bisel Co. of Philadelphia (800-247-3526) has just published Ken
Gormley, Principal Ed., Jeffrey Bauman, Joel Fishman, Leslie Kolzar,
Associate Eds.The Pennsylvania Constitution: A Treatise on Rights and
Liberties (2004). This 1000 page (exactly) deals with Article I
(Declaration of Rights) of the Pennsylvania Constitution in 35 chapters (28
for the article, 2 introductory, three additional topics not under specific
sections (due process or freedom of expression) and amending the
constitution, appendix, plus bibliography, table of cases, index.
I wish to bring this book to your attention because the book is based on
the case of Com. v. Edmunds, 586 A.2d 887 (Pa. 1991) in which the PA
Supreme Court put forth a four-prong approach in dealing with any
constitutional law issue: 1) the text of the Pennsylvania Constitutional
provision; 2) the history of the provision, including Pennsylvania
case-law; 3) related case-law from other states; 4) policy considerations,
including unique issues of state and local concern, and applicability
within modern Pennsylvania jurisprudence. The chapters in the book follow
this approach to help both judge and lawyer interpret this Article.
The authors of this book are law professors, judges, and practicing
attorneys. It is the first-full length work of this kind on this topic.
Since the Declaration of Rights is similar in many of the states, the
format may also be useful for anyone who wanted to do a similar type work
for their state.
I did not list the price because I believe it is in a pre-publication cost
before July 1, but it is around $125.00 to $150.00.
