Given the performance by House Democrats today and the likely
performance by Senate Democrats tomorrow or soon, which is more likely.

1.  The Supreme Court, which has in the pornography area, been willing
to curb Ashcroft's more extreme tendencies, will in a case with really
good civil libertarian facts, in some way, probably small, limit recent
government practices with respect to detainees.

2.  Elected Democrats vote as a block in favor of laws or rules limiting
executive power.

My bet is that Anthony Kennedy will be more of a civil libertarian than
Dick Gephardt.  Not much more.  But more.
