I will leave it to others to judge my tone, although I want to assure each
and every member of this list (and each and every person who teaches,
whether it be law, or anything else, at any institution, whether it be a
law school or someplace else) of my highest personal regards.
Nevertheless, the community of academic lawyers continues to fight B v. G.
with incredible fervor. It has already been pointed out by a number of us
that the decision can readily be seen as statutory interpretation, and
that this might arguably indicate that the Republicans' arguments on the
merits are not as strong as they might seem at first blush. Nonetheless,
the beat goes on, and let each decide for himself, herself, or itself
whether that is a good thing.
