You may want to see my piece "Penumbral Reasoning on the
Right," 140 U. Penna. L. Rev. 1333 (1992), and the followup
"Comfortably Penumbral," 77 B.U. L. Rev. 1089 (1997) (w/ Brannon
Denning) both of which address that topic. But don't let that stop
you: I think there's a lot more to say on the subject than those two
pieces managed to address.
