The S. Ct. has just granted cert in Eldred v. Ashcroft; the main
issue there is whether Congress exceeded its constitutional power by
enacting the Copyright Term Extension Act, which extended by 20 years the
term of protection both for new copyright works and for already created
ones. There's also a First Amendment claim, but the Congressional power
claim has so far gotten the most play. Larry Lessig has been fighting this
on behalf of Eldred, who is challenging the statute (and I assume Larry will
be the one arguing it before the Court).
