Two Queries

I'm looking for books and articles on two questions that have some relevance
to the ongoing discussions we've been having:

1) discussions/analyses of the Lincoln administration and civil liberties

2) legal, philosophical, and other writings on the idea of collective
responsibility (i.e., the degree to which citizens or government officials
who do not carry out government acts can still be held accountable for those
acts).  There was some discussion of this idea during the bombing of Serbia,
and I imagine studies of Nazi Germany might touch on the topic as well.  I'm
interesting in case studies and general treatments.
