Implied Fundamental Rights

In a glossary for my conlaw course I describe implied fundamental rights as "implicit in the concept of ordered liberty," or "deeply rooted in this Nation's history and tradition," or as part of "the traditions and [collective] conscience of [the] people." I seem to remember a more recent pronouncement by the SC on the criterion for identifying implied fundamental rights.  Does anyone know what this more recent statement is and where it is located? I'd be happy to take the answer off-line. Thanks.
