Shubba objects: "Malla's factors make sense to me, but I also wonder
if they are really about what makes a justice great as
opposed to respectable or merely competent"
I would argue that a Justice who is not respectable should not be
considered great. For that reason, much as I believe that Scalia is the
best writer on the current court, I would not want my students to use
him as a role model (even putting aside that I am widely to his left).
I am offended by judges who "hide the ball."
