Let's see.  A lawyer argues several cases before trhe Court, wins most of
them, and becomes Solicitor General.  Does that put you among the possible
appointees to the Supremes?  Whatever your color, gender, religion, or
background?

Well, the path from "tenth justice" to one of the nine was not without
precedent by 1967.
