A Self-Inflicted Wound that Won't Hurt

Howard:  Why would Scalia be unacceptable as Chief
Justice?  Will not all the Republicans have to
accept him?  Will not one or two Democrats (such as John
Breaux) also accept him?  It might be a long fight, all
that is needed is 51 votes.

Many others are using the term "self-inflicted wound."  I
have used the term "judicial coup d'etat."  A coup does not
require institutional legitimacy.  It merely requires
power.
